Marriage On Trial

Marriage benefits society – especially children – in ways no other relationship can. That’s why marriage policy is rooted in the reality that children need a mother and a father. On March 26th and 27th, the U.S. Supreme Court heard two different cases that put the public purpose of marriage on trial. The cases are different, but the implications are the same: the High Court wasconfronted with whether the public purpose of marriage can remain to unite men and women to each other and the children they produce; or be legally redefined to give social approval to any combination of adults.

Quotes from the Court:

"Traditional marriage has been around for thousands of years. Same-sex marriage is very new… You want us to step in and render a decision based on an assessment of the effects of this institution which is newer than cell phones or the Internet?"Justice Samuel Alito

"I'm not sure that it's right to view this as excluding a particular group… when the institution of marriage developed historically, people didn't get around and say, 'let's have this institution but let's keep out homosexuals.' The institution developed to serve purposes that by their nature did not include homosexual couples."Chief Justice John Roberts to Ted Olson, attorney opposing Prop 8

"We have 5 years of information to weigh against 2,000 years of history, or more…the problem with this case is that you're really asking…for us to go into unchartered waters…"Justice Anthony Kennedy

"As far as I can tell, political figures are falling over themselves to endorse your side of the case."Chief Justice John Roberts to Roberta Kaplan, attorney opposing DOMA
